These Terms of Service (“Terms”) constitute a legally binding agreement between you (the “Client”) and Titan Forge LLC (“Titan Forge,” “we,” “our,” or “us”). By requesting, commissioning, or engaging in any services provided by Titan Forge, you agree to be bound by these Terms in full. These Terms supersede all prior agreements, verbal or written, and cannot be modified except in writing signed by both parties.

  1. Services Provided Titan Forge provides custom metal fabrication, welding, mobile welding, design consultation, and other related services. All services are delivered according to mutually agreed-upon scope, pricing, and deadlines stated in formal written estimates, work orders, or proposals. No services are guaranteed outside of these written agreements.
  2. Quotes and Payment: Quotes are valid for 15 calendar days unless otherwise stated in writing. All quotes are subject to change based on scope modifications or material cost fluctuations. A non-refundable deposit may be required prior to project start. Final payment is due upon completion unless alternate arrangements have been approved in writing. A 5% late fee will be applied to unpaid balances after 15 calendar days. If payment is not made within 30 days of final invoice, the project will be considered complete and closed. Titan Forge may charge storage fees, refer the balance to collections, or pursue legal remedies. All materials remain the property of Titan Forge until paid in full.
  3. Scheduling and Cancellations: Scheduling is at the sole discretion of Titan Forge and is subject to availability, weather, equipment maintenance, material delays, or safety considerations. Clients canceling or rescheduling appointments must provide a minimum of 48 hours’ notice. Titan Forge reserves the right to charge a cancellation fee of up to 25% of the project total for late cancellations or no-shows.
  4. Custom Work and Client Approvals: Custom fabrication requires collaboration. Titan Forge may provide mockups, CAD drawings, or prototypes for approval. Client approval (verbal or written) is binding. Any change requests after approval may result in additional charges or delivery delays. Titan Forge reserves the right to decline modifications that compromise structural integrity, safety, or code compliance.
  5. Warranty and Limitations: Titan Forge warrants the structural integrity of its welds and fabrication under normal use for 12 months from the completion date. This warranty excludes finishes, coatings, and surface corrosion unless otherwise specified. Warranty is voided if the product is altered, improperly maintained, misused, exposed to chemicals or extreme environments, or installed by anyone other than Titan Forge (if installation was part of the scope).
  6. Limitation of Liability: Titan Forge shall not be liable for incidental, indirect, or consequential damages including loss of income, equipment failure, or project delays. Liability, if any, is strictly limited to the total amount paid by the Client for the specific service rendered. Clients assume full responsibility for use and application of all products and services once delivered.
  7. Intellectual Property Rights: All concepts, designs, technical drawings, schematics, and physical prototypes produced by Titan Forge are the intellectual property of Titan Forge unless transferred explicitly in writing. Unauthorized reproduction, sharing, or use of these materials is strictly prohibited.
  8. Privacy and Confidentiality: Titan Forge maintains strict confidentiality over all client data, proprietary project details, and communications. Information is used solely for the purposes of project fulfillment, billing, and legal compliance. We do not sell, trade, or disclose personal data.
  9. Shop Environment and Vehicle Condition: Titan Forge operates as a fabrication and welding shop. While we take all reasonable precautions to protect vehicles and parts from cosmetic damage, the Client acknowledges that welding, cutting, grinding, and fabrication work inherently carry risks of cosmetic imperfections such as scratches, dings, or heat-related warping. Titan Forge is not responsible for incidental cosmetic damage resulting from standard fabrication practices.
  10. Damage During Fabrication Disclaimer: The Client acknowledges that welding, cutting, grinding, and structural modifications carry inherent risks, including potential heat transfer, electrical interference, or incidental damage to adjacent components. While Titan Forge takes reasonable precautions to minimize risk, the Client agrees that Titan Forge shall not be held liable for any non-cosmetic, unintended damage that may occur during fabrication or installation.
  11. Indemnification / Hold Harmless Clause: The Client agrees to release, indemnify, defend, and hold harmless Titan Forge LLC, its owners, and employees from any liability, claim, loss, or expense (including attorney fees) arising out of or related to:

    (a) Damage to any property or equipment—including but not limited to trailers, recreational vehicles (RVs), motor vehicles, gates, staircases, railings, furniture, custom structures, or other fabricated components—occurring during fabrication, modification, repair, or installation;

    (b) Any subsequent damage, accident, or loss caused by towing, hauling, lifting, or misuse of the fabricated or modified components, including overloading beyond manufacturer or regulatory limits;

    (c) Third-party claims or damages, including personal injury or property damage, resulting from the use, installation, or application of products or services provided by Titan Forge.

  12. Dispute Resolution and Governing Law: These Terms shall be governed by the laws of the State of Utah. Any dispute shall be resolved first through good faith negotiation. If unresolved, disputes shall be settled by binding arbitration in Utah County, Utah. The prevailing party shall be entitled to recover legal fees and costs.
  13. Modifications to Terms: Titan Forge reserves the right to update or modify these Terms at any time. Any changes will take effect immediately upon publication to https://utahwelder.com/terms-of-service/. Clients are encouraged to review Terms regularly.
  14. Force Majeure: Titan Forge shall not be held liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, labor disputes, pandemics, supply chain disruptions, or governmental actions.
  15. Acceptance of Terms: By engaging Titan Forge for services, the Client acknowledges that they have read, understood, and agreed to these Terms of Service in their entirety.
